ORDER OF DISMISSAL

   On Wednesday, February 17, 1999, a telephone conference was held between representatives of the parties, Mr. August Mangoni for the Complainant, and Mr. Dan Hornbeck for the Respondent, at which Mr. Mangoni informed the undersigned that, after a discussion with the Complainant, Lawrence Hartigan, he had decided not to proceed with the case. This was confirmed in a letter dated February 18, 1999, which stated that he had, "reviewed the matter with Mr. Hartigan and it was his decision not to pursue this matter further." In light of these representations, therefore,

   IT IS ORDERED that the matter is hereby dismissed without prejudice.
