DECISION AND ORDER APPROVING SETTLEMENT AGREEMENT

   This case arises under the employee protection provision of the Surface Transportation Assistance Act of 1982 (STAA), as amended, 49 U.S.C. §31105 (1994). On February 3, 1999, the parties filed a Settlement Agreement, the terms of which are hereby incorporated by reference, and a copy of which is attached for ease of reference.

   This Administrative Law Judge, having reviewed the Settlement Agreement, concludes that this settlement agreement is a fair, adequate and reasonable settlement of the complaint and it is therefore ORDERED that the settlement agreement shall be, and the same hereby is APPROVED pursuant to the provisions of 29 C.F.R. §1978.111(d)(2).
