ORDER OF DISMISSAL

   The above-referenced matter was the subject of a formal hearing before the undersigned Administrative Law Judge on September 25, 2000. The parties advised the Court that they had reached a voluntary resolution of this matter and would file the appropriate settlement papers with the Court. On October 17, 2000, counsel for Respondent provided Complainant with a copy of the draft settlement agreement for his approval, which Complainant failed to execute. On February 21, 2001, counsel for respondent notified this Court that she continued to await Complainant's signature of the settlement agreement and, if not forthcoming, would be filing a motion to enforce the settlement agreement, which she subsequently filed on March 29, 2001.

   By facsimile transmission dated April 19, 2001, Complainant notified this Court that he had decided to decline the Respondent's offer of settlement and wished to withdraw his complaint. Respondent has filed no objection thereto.

   Accordingly, in view of the foregoing the above-captioned matter is hereby DISMISSED WITH PREJUDICE.
