DECISION AND ORDER APPROVING SETTLEMENT
AND DISMISSING CASE

    This proceeding arises under the employee protection provision of the Surface Transportation Assistance Act, hereinafter the "STAA", 49 U.S.C. Section 31105 (1982), which prohibits covered employers from discharging or otherwise discriminating against employees who have engaged in certain protected activities. On March 13, 2000, the parties filed a fully executed Settlement Agreement, attached hereto and made a part hereof. I have examined the consent and conclude that all issues in contest between the parties have been resolved and I find the terms fair, adequate and reasonable. Accordingly,

    IT IS HEREBY ORDERED that the Settlement Agreement is hereby APPROVED.

    IT IS HEREBY ORDERED that the Settlement Agreement be made a part of this Decision and Order;

    AND IT IS FURTHER ORDERED that this action is hereby dismissed subject to provisions of the Settlement Agreement.
