ORDER

    The above-captioned matter is presently pending before Administrative Law Judge Edith Barnett. However, Complainants filed a motion on January 15, 1997 requesting the appointment of a settlement judge. Because 29 C.F.R. § 18.9(e)(2)(i) provides that a settlement judge may only be appointed by the Chief Administrative Law Judge when no party objects to such referral, I ordered the other parties to respond to Complainants' request. The Respondent Department of Energy has filed a statement objecting to the appointment of a settlement judge in this matter.

    Accordingly, Complainants' requested for the appointment of a settlement judge is DENIED.
