     By motion dated October 5, 1994, Complainant and
Respondent filed a Stipulation of Dismissal signed by both
parties.


     The parties request that the above-captioned case be
dismissed without prejudice pursuant to Rule 41(a)(ii) of
the Federal Rules of Civil Procedure.



     It appears that the parties have complied with the
appropriate rule governing dismissal by Stipulation. 
According, it is recommended that the above-captioned case
