ORDER ALLOWING WITHDRAWAL OF COMPLAINT UPON SETTLEMENT

    This is a proceeding under the Clean Air Act (42 U.S.C. § 7622) and implementing regulations at 29 C.F.R. Part 24. A hearing had been previously scheduled but continued at the request of the parties upon indication that the matter may have been settled. On January 12, 1988, Counsel for Yeargin Construction Company, Inc., Joseph A. Rhodes, Jr., Esq., filed a

"Settlement Agreement and Release of Claims." This agreement is executed by the Plaintiff, Clarence W. Crider; Plaintiff's Counsel, D. Bruce Shine, Esq.; Hiram Tipton, Esq., Counsel for Holston Defense Corp. and Counsel for Yeargin Construction.

    In accordance with the terms of the settlement agreement, a copy of which is attached hereto and incorporated by reference, it is hereby ordered that the complaint filed by Clarence W. Crider is allowed to be withdrawn without any findings regarding the merits of the Complaint under the Clean Air Act.
