ORDER DENYING AND DISMISSING COMPLAINT

There being no evidence that the party charged has violated the law by somehow discriminating against the complainant for any reason, it is recommended that the charges comprising the grievance be dismissed and the subject complaint be denied. It appears from the record that the complainant's termination was solely the result of his past unsatisfactory job performance. The complaint's involvement with EPA followed his dismissal for other unrelated causes.
