In the Matter of:

DAVID MARSHALL HIGH
    Complainant

    v.

LOCKHEED MARTIN ENERGY SYSTEMS, INC.
    Respondent

ORDER OF REMAND

The above-captioned claim, was docketed with the Office of Administrative Law Judges on November 1, 2001, and assigned to the undersigned on November 13, 2001. The administrative file received by the undersigned contained only a letter dated November 1, 2001, from Complainant's counsel to the undersigned addressing two issues. First, Complainant requests a de novo hearing on the issue of the disappearance of the record in the complainants October 9, 2001, nuclear and environmental whistleblower claim. Additionally Complainant requests that the claim be remanded for an OSHA investigation.

Considering the limited information available to this court, a remand is appropriate for the development of evidence regarding Complainant's allegations.

ORDER

IT IS HEREBY ORDERED that this case be remanded for appropriate action.
