In the Matter of Marsha Delaura, WPC-101 (Sec'y Nov. 26, 1979)

UNITED STATES OF AMERICA
DEPARTMENT OF LABOR
CASE NO. WPCA-101

In The Matter of

MARSHA DELAURA

O R D E R

Marsha DeLaura filed a complaint alleging that she was discharged from her employment by the Greater Erie Community Action Committee because of activities to carry out the purposes of the Federal Water Pollution Control Act, as amended, in violation of Section 1367 of that Act (33 U.S.C. 1367)

An investigation of the allegations revealed that Ms. DeLaura's employment was terminated for reasons unrelated to any actions on her part to carry out the purposes of the Federal Water Pollution Control Act, and that no violation of that Act or other federal law was committed.

Ms. DeLaura and the Greater Erie Community Action Committee were advised of the results of the investigation, and an opportunity for a hearing was offered. Neither party has requested a hearing.

Accordingly, I find that it has not been shown that Marsha DeLaura's employment was terminated because of actions protected by law as alleged, and the complaint is hereby dismissed.

Dated at Washington, D.C.
