ORDER GRANTING MOTION TO WITHDRAW COMPLAINT AND DISMISS ACTION
This proceeding arose under the Federal Water
Pollution Control Act, 33 U.S.C. §1251 et seq. A formal
hearing was scheduled for December 22-24, 1986, on Enid,
Oklahoma.
The parties have filed a Joint Motion to
withdraw the complaint and dismiss the action with prejudice.
They further request cancellation of the hearing and they agree
that each side shall bear its costs incurred to date.
Good cause having been shown, it is hereby
ORDERED that the Motion to Withdraw the complaint is granted and
the above-captioned case is DISMISSED with prejudice. The
scheduled hearing is hereby cancelled.
It is further ORDERED that each side shall bear
its costs incurred to date.
