RECOMMENDED DECISION AND ORDER APPROVING SETTLEMENT AND DISMISSING CASE
This proceeding arises under §210 of the Energy Reorganization
Act of 1974, 42 U.S.C. §5851 (1982), as amended ("ERA") and
[Page 2]
the implementing regulations at 29 C.F.R. Part 24. Section 5851
of the ERA prohibits a Nuclear Regulatory Commission ("NRC")
licensee from discharging or otherwise discriminating against an
employee who has engaged in protected activities as set forth in
the Act.
By Motion dated April 22, 1992, complainant seeks dismissal
of his complaint and acceptance of the appended Settlement Agreement,
signed by the parties and their respective counsel. Also
appended to the motion, is a General Release, signed by the
complainant acknowledging receipt of the consideration described in
full satisfaction of any and all claims growing out of his employment
with the respondent foundation.
I have reviewed the terms of the settlement agreement, and I
find it fair, adequate, and reasonable. Accordingly, it is
RECOMMENDED that the Secretary of Labor enter an order dismissing
the case with prejudice.
