BEFORE: THE SECRETARY OF LABOR NOTICE OF CASE CLOSING This case arises under Section 405, the employee protection provision, of the Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C.A. § 31105 (1994). On February 6, 1995, Complainant filed a Motion To Dismiss with the Administrative Law Judge (ALJ) who, on February 10, 1995, issued an Order of Dismissal which cancelled the hearing scheduled for March 30, 1995, and dismissed the matter with prejudice. In accordance with the ALJ's order and pursuant to 29 C.F.R. § 1978.111(3), this case is closed. SO ORDERED. For the Secretary of Labor DAVID A.
