          DECISION AND ORDER DISMISSING COMPLAINT

     Upon consideration of Respondent's Motion for Summary
Judgment, filed September 5, 1995, and Complainant's Dismissal,
dated September 18, 1995; and it appearing that this matter has
been pending since October 19, 1994, with the scheduling of several
formal hearings which have had to be postponed, primarily at
Complainant's instance; and it further appearing that the complaint
has had no colorable basis under the statute invoked; it is deemed
that the matter should be dismissed upon the appropriate term.  It
is, therefore,

     ORDERED that the complaint is dismissed, with prejudice.
