DATE: September 5, 1995
CASE NO. 93-MSP-37
IN THE MATTER OF
WALTER ROBERTS.
BEFORE: THE SECRETARY OF LABOR
REMAND ORDER
The Administrative Law Judge (ALJ) granted the motion for
summary judgment of the Administrator of the Wage and Hour
Division revoking Walter Roberts' certificate of Registration
under the Migrant and Seasonal Agricultural Worker Protection
Act, 29 U.S.C. §§ 1801-72(1988). Mr. Roberts filed a
petition for review of the ALJ's order and that petition was
granted. The Administrator filed a response to a briefing
schedule issued by the Office of Administrative Appeals (OAA) in
which she stated "it would best serve the interests of the
Secretary to remand this case for further consideration by the
Administrative Law Judge. . . ."
Accordingly, for good cause shown, this matter is REMANDED
to the Administrative Law Judge. On remand, the parties and the ALJ should address the questions set forth in the OAA Dec. 1993
Briefing Schedule and Statement of Issues Raised.
SO ORDERED.
For the Secretary of Labor
Acting Director, Office of
Administrative Appeals [1]
Washington, D.C.
