BEFORE: THE ADMINISTRATIVE REVIEW BOARD

   On February 16, 2000, the Board issued a Notice of Case Closing. The notice contained an error in the ARB case numbering. The Respondents filed a petition for review on January 11, 2000 and this case was docketed as ARB Case No. 00-022. The Administrator of the Wage and Hour Division filed a petition for review on January 21, 2000 and this cross appeal was docketed as ARB Case No. 00-031. On February 8, 2000, the Administrator filed a motion withdrawing his appeal. The Board granted the Administrator's motion and closed ARB Case No. 00-022. It is ARB Case No. 00-031 which should have been closed. The Respondent's appeal, ARB Case No. 00-22 is still pending.
