ORDER PURSUANT TO
STIPULATION AGREEMENT
This case arises under the minimum wage and
overtime provisions of the Fair Labor Standards Act (FLSA), as
amended, 29 U.S.C. § 216(e), and the applicable regulations
issued at 29 C.F.R. Parts 578.
By certified letter delivered February 6,
1995, the Department of Labor (DOL) notified Respondent of a
civil money penalty in the amount of $60,000,00 for violations of
the above-mentioned Act and regulations. By letter dated
February 16, 1995, Respondent filed a request for a hearing. DOL
filed an Order of Reference in this Office on May 30, 1995. This
Office issued a Notice of Docketing and Pre-Hearing Order on June
12, 1995 which required both parties to file certain information
regarding this matter. After an extension was granted, both
parties filed responses to the Pre-Hearing Order on August 14,
1995. DOL also filed a Motion to Stay Proceedings to allow time
to resolve this matter. The motion was granted on August 31,
1995. On June 11, 1996, DOL filed a Stipulation Agreement in
this case.
Review of the Consent Findings show that they
fairly and adequately resolve all pending issues in this matter.
Accordingly, the Consent Findings are hereby APPROVED and ADOPTED
in their entirety.
