ORDER OF DISMISSAL
This proceeding arises under the Fair Labor
Standards Act of 1938, as amended (29 U.S.C. §201, et
seq.), hereinafter the Act, and its implementing regulations at
29 C.F.R. Parts 579 and 580. This matter comes on for consideration
of an Order of Reference by the Administrator of the Wage and Hour
Division, issued on November 16, 1994, imposing a civil money
penalty upon the Respondents for alleged violation of the Act and
applicable regulations.
On July 12, 1996, the Administrator of the Wage
and Hour Division, by counsel, filed a Notice of Withdrawal of
Order of Reference. Therefore,
IT IS ORDERED that the Order of Reference dated
November 16, 1994, be, and it hereby is, DISMISSED, with each party
bearing its own costs, fees (including attorney's fees) and
expenses as may have been incurred in connection with any stage of
these proceedings.
