                         ORDER OF DISMISSAL

     On April 21, 1995, the Administrator, Wage and Hour Division,
Employment Standards Administration (the Administrator), stated
that the civil money penalty assessed by the Administrator in the
above-captioned matter has been withdrawn.  Consequently, the
Administrator requested that the formal hearing scheduled for May
22, 1995 be canceled.

     On April 28, 1995, Respondent joined the Administrator's
request.

     Since the formal hearing in this matter was requested by 
Respondent and Respondent no longer desires a formal hearing, the
Administrator's request is GRANTED and the matter is hereby
DISMISSED.
