49 CFR, Subchapter C - Civil Aviation Security
Security Regulations
Title 49 of the Code of Federal Regulations (CFR), Chapter XII, Subchapter C contains Transportation Security Administration's (TSA) rules for civil aviation security. Below is a brief description for each part of Subchapter C, along with a link to the Electronic Code of Federal Regulations (e-CFR) and a link to TSA's regulatory history documents. Where applicable, parts that are "(Reserved)" are proposed additions or amendments to the CFR. These parts are not linked to the e-CFR until the amendments become final. However, TSA's regulatory history sections for these parts are available for viewing.
Part 1540 Civil Aviation Security: General Rules
Contains rules that cover all segments of civil aviation security. It contains definitions that apply to Subchapter C, and it contains rules that apply to passengers, aviation employees, and other individuals and persons related to civil aviation security, including airport operators, aircraft operators, and foreign air carriers.
Requires airport operators to adopt and carry out a security program approved by TSA. It describes requirements for security programs, including establishing secured areas, air operations areas, security identification display areas, and access control systems. This part also contains requirements for fingerprint-based criminal history record checks of specified individuals. This part describes the requirements related to Security Directives issued to airport operators.
Part 1544 Aircraft Operator Security: Air Carriers and Commercial Operators
Applies to certain aircraft operators holding operating certificates for scheduled passenger operations, public charter passenger operations, private charter passenger operations, and other aircraft operators. This part requires such operators to adopt and carry out a security program approved by TSA. It contains requirements for screening of passengers and property. This part also describes requirements applicable to law enforcement officers flying armed aboard an aircraft, as well as requirements for fingerprint based criminal history record checks of specified individuals. This part describes the requirements related to Security Directives issued to aircraft operators.
Part 1546 Foreign Air Carrier Security
Applies to foreign air carriers operating in the United States and holding a permit issued by the Department of Transportation under 49 U.S.C. 41302, or other appropriate authority issued by the Civil Aeronautics Board or the Department of Transportation. This part requires such carriers to adopt and carry out a security program approved by TSA. It describes requirements for screening of passengers and property and other requirements.
Part 1548 Indirect Air Carrier Security
Applies to indirect air carriers, such as freight forwarders. It requires such carriers to adopt and carry out a security program and describes requirements for preventing the carriage of unauthorized explosives or incendiaries aboard passenger aircraft.
Part 1550 Aircraft Security Under General Operating and Flight Rules
Applies to the operation of aircraft for which there are no security requirements in other parts of Chapter XII, including general aviation aircraft.
Prohibits a flight school from providing flight training to aliens and other individuals designated by TSA (candidates) unless the flight school or the candidate submits certain information to TSA, the candidate remits the specified fee to TSA, and TSA determines that the candidate is not a threat to aviation or national security. Requires flight schools to provide security awareness training to personnel.
Part 1554 Aircraft Repair Station Security (Reserved)
Applies to domestic and foreign aircraft and aircraft component repair stations that are certificated by the Federal Aviation Administration pursuant to 14 CFR 145. This part provides for the security of maintenance and repair work conducted on aircraft and aircraft components at domestic and foreign repair stations, of the aircraft and aircraft components located at the repair stations, and of the repair station facilities as required in 49 U.S.C. 44924.
Part 1560 Secure Flight Program (Reserved)
Enables TSA to operate a screening program known as Secure Flight, which involves the comparison of identifying information of airline passengers with the identifying information of individuals on Federal Government watch lists. The provisions of this part are intended to facilitate the detection of individuals identified on Federal Government watch lists who seek to travel by air, and to facilitate the secure travel of the legitimate air travelers who make up the vast majority of the traveling public.
Part 1562 Operations in the Washington, DC, Metropolitan Area
Applies to the following airports, and individuals who operate an aircraft to or from those airports, that are located within the airspace designated as the Washington, DC, Metropolitan Area Flight Restricted Zone by the Federal Aviation Administration: (1) College Park Airport (CGS); (2) Potomac Airfield (VKX); and (3) Washington Executive/Hyde Field (W32).
