What are Significant Guidance Documents?

The term “guidance document” means an agency statement of general applicability and future effect, other than a regulatory action (i.e., any substantive action by an agency that promulgates or is expected to lead to the promulgation of a final regulation), that sets forth a policy on a statutory, regulatory or technical issue or an interpretation of a statutory or regulatory issue. Guidance documents encompass all guidance materials, regardless of format (e.g., written, video, audio-tapes, etc.) and include agency interpretations or policies that relate to, among other things, the production, manufacturing, control, testing, and analysis or assessment of products.

“Significant” guidance documents are those disseminated to regulated entities or the general public having substantial economic (an anticipated impact over $100 million), legal, or policy implications. Certain guidance documents are not “significant,” including speeches, Congressional correspondence, press materials, and internal agency policies.
