EPA is proposing to find that greenhouse gases in the atmosphere endanger the public health and welfare of current and future generations. The Administrator proposes to find that atmospheric concentrations of greenhouse gases endanger public health and welfare within the meaning of Section 202(a) of the Clean Air Act. She proposes to make this finding specifically with respect to six greenhouse gases that together constitute the root of the climate change problem: carbon dioxide, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride. The Administrator is also proposing to find that the combined emissions of carbon dioxide, methane, nitrous oxide, and hydrofluorocarbons from new motor vehicles and new motor vehicle engines are contributing to this mix of greenhouse gases in the atmosphere. Comments on this proposed action must be received on or before June 23, 2009. EPA is proposing to require accredited providers of renovator or dust sampling technician training to submit post-course notifications, including digital photographs of each successful trainee, to EPA. Additionally, EPA is proposing to remove the requirement for accredited lead-based paint activities training providers--those who provide inspector, risk assessor, project designer, and abatement supervisor and worker training--to submit to EPA a digital photograph of each successful trainee along with their post-course notifications. NRCS intends to issue a series of revised conservation practice standards in its National Handbook of Conservation Practices. These standards include: Anaerobic Digester (Code 366); Anionic Polyacrylamide (PAM) Application (Code 450); Brush Management (Code 314); Fish Raceway or Tank (Code 398); Irrigation Ditch Lining (Code 428); Irrigation Pipeline (Code 430); Irrigation Reservoir (Code 436); Surface Drain, Field Ditch (Code 607); Surface Drainage, Main or Lateral (Code 608); Roof Runoff Structure (Code 558); and Surface Roughening (Code 609). These practices may be used in conservation systems that treat highly erodible land or on land determined to be a wetland. Comments are due 15 May 2009. Final versions of these new or revised conservation practice standards will be adopted after the close of the 30-day comment period, and after consideration of all comments. The Corps is removing a sentence in the preamble that was published in the March 12, 2007, final notice for the reissuance of the Nationwide Permits and replacing that sentence and providing additional clarification. The preamble language at issue concerns when a pre-construction notification is required in connection with NWP 46, and the Corps is soliciting comments on the removed sentence, the replacement sentences, and the additional clarification provided in this notice. The Corps is not proposing any changes to the terms and conditions of NWP 46. Comments are due 15 May 2009. This proposed regulation requires reporting of greenhouse gas emissions from all sectors of the economy. The rule would apply to fossil fuel suppliers and industrial gas suppliers, as well as to direct greenhouse gas emitters. The proposed rule does not require control of greenhouse gases, rather it requires only that sources above certain threshold levels monitor and report emissions. EPA Regions 1 through 10 are proposing an NPDES Vessel General Permit (VGP) to cover discharges incidental to the normal operation of commercial vessels and recreational vessels greater than or equal to 79 feet in length and an NPDES Recreational General Permit (RGP) to cover discharges incidental to the normal operation of recreational vessels less than 79 feet in length. This action is in response to a District Court ruling that vacates, as of September 30, 2008, a long-standing EPA regulation that excludes discharges incidental to the normal operation of a vessel from the need to obtain an NPDES permit. EPA is proposing to reissue its stormwater Construction General Permit for a two-year time period. The permit would apply where EPA is the permitting authority, which is in five states, most territories, and most Indian country lands. The draft permit uses the same terms and conditions as EPA's 2003 permit, which expires in July 2008. EPA is proposing the permit to coordinate with a second effort that is underway to establish national clean water standards, known as an effluent limitation guideline, for the construction and development industry. Upon finalization of the guideline, EPA plans to include its provisions into a new and improved Construction General Permit to be reissued no later than July 2010. EPA is also requesting comment on the criteria the agency will use to recognize local erosion and sediment control program requirements in this and future permits. The Draft Inventory is available for public review. Annual U.S. emissions for the period of time from 1990 through 2006 are summarized and presented by source category and sector. The inventory contains estimates of carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFC), perfluorocarbons (PFC), and sulfur hexafluoride (SF6) emissions. The inventory also includes estimates of carbon fluxes in U.S. agricultural and forest lands. The technical approach used in this report to estimate emissions and sinks for greenhouse gases is consistent with the methodologies recommended by the Intergovernmental Panel on Climate Change (IPCC), and reported in a format consistent with the United Nations Framework Convention on Climate Change (UNFCCC) reporting guidelines. The Inventory of U.S. Greenhouse Gas Emissions and Sinks: 1990-2006 is the latest in a series of annual U.S. submissions to the Secretariat of the UNFCCC. This action is a supplemental notice of proposed rulemaking(SNPRM) to EPA's June 30, 2006, notice of proposed rulemaking (NPRM)revising the National Pollutant Discharge Elimination System (NPDES) permitting requirements for concentrated animal feeding operations (CAFOs), in response to the order issued by the U.S. Court of Appeals for the Second Circuit in Waterkeeper Alliance et al. v. EPA, 399 F.3d 486 (2d Cir. 2005). In the June 2006 NPRM, EPA proposed to require only CAFOs that discharge or propose to discharge to seek coverage under a permit. In this SNPRM, EPA is proposing a voluntary option for CAFOs to certify that the CAFO does not discharge or propose to discharge based on an objective assessment of the CAFO's design, construction, operation, and maintenance. The June 2006 proposal also discussed the of the nutrient management plan (NMP) that would need to be incorporated into NPDES permits. This SNPRM proposes a framework for identifying the terms of the NMP and three alternative approaches for addressing rates of application of manure, litter, and process wastewater when identifying terms of the NMP to be included in the permit. Without these amendments, owners/operators of new stationary combustion turbines burning biogas (landfill gas, digester gas, etc) containing relatively low amounts of sulfur-containing compounds will be required to install pretreatment facilities to remove the sulfur compounds prior to combustion or to install post combustion controls to lower sulfur dioxide emissions. EPA is granting a specific exemption from requirements to petition the EPA inA order to import used ozone-depleting substances. The exemption would apply to entities that import spherical pressure vessels containing halon 1301 for aircraft fire extinguishing (``aircraft halon bottles'') for purposes of hydrostatic testing. This final rule reduces the administrative burden on entities that are importing aircraft halon bottles for the purpose of maintaining these bottles to meet commercial safety specifications and standards set forth in airworthiness directives of the Federal Aviation Administration. EPA is establishing a new category of excluded fuel that has its own set of conditions, some of which overlap with the comparable fuels exclusion. These newly excluded hazardous secondary materials are called "emission-comparable fuel" (ECF). ECF is a hazardous secondary material that, when generated, is handled in such a way that it is not discarded in any phase of management, but rather is handled as a valuable commodity. ECF meets all of the hazardous constituent specifications (over 160) for comparable fuel, with the exception of those for oxygenates and hydrocarbons (constituents which contribute energy value to the fuel). The rule specifies conditions on burning ECF which assure that emissions from industrial boilers burning ECF are comparable to emissions from industrial boilers burning fuel oil. The ECF exclusion also includes conditions for tanks and containers storing ECF to assure that discard does not occur. This final rule is effective January 20, 2009. The 2008 Vessel General Permit (VGP) regulates discharges incidental to the normal operation of vessels operating in a capacity as a means of transportation. Due to a ruling by the U.S. District Court for the Northern District of California, vessel owners and operators who have previously been exempt from Clean Water Act requirements for the last 35 years will now require a permit starting Dec. 19. The ruling revoked 40 CFR 122.3(a)) which concerns the exclusion of discharges incidental to the normal operation of a vessel as of February 6, 2009. The VGP covers non-recreational vessels 79 ft in length or longer, such as cruise ships or oil and cargo tankers, but excludes fishing vessels of any length, unless they discharge ballast water. The VGP incorporates the Coast Guard's mandatory ballast water management and exchange standards, and provides technology-based and water-quality-based effluent limits for other types of discharges, including deck runoff from rain or cleaning, ballast water used to stabilize ships and "gray water" from showers, sinks and laundry machines. It also establishes specific corrective actions, inspections and monitoring, recordkeeping and reporting requirements. On October 12, 2005, EPA promulgated NESHAP for new and existing sources at hazardous waste combustion facilities. Subsequently, the EPA received four petitions for reconsideration of the final rule. EPA granted reconsideration with respect to eight issues raised by the petitions and EPA re-opened the rule to consider comments relating to a post-promulgation decision of the United States Court of Appeals for the District of Columbia Circuit. As a result of this reconsideration process, EPA is revising the new source standard for particulate matter for cement kilns and for incinerators that burn hazardous waste. EPA is also making amendments to the particulate matter detection system provisions and revisions to the health-based compliance alternative for total chlorine of the final rule. EPA Regions 1, 2, 3, 5, 6, 9, and 10 today are finalizing EPA's NPDES general permit for stormwater discharges from industrial activity, also referred to as the Multi-Sector General Permit (MSGP). The MSGP consists of thirty four (34) separate Regional EPA permits that may vary from each other based on State or Tribal water quality-based requirements. This permit replaces the existing permits that expired on October 30, 2005. As with the earlier permits, this permit authorizes the discharge of stormwater associated with industrial activities in accordance with the terms and conditions described therein. Industrial dischargers have the choice to seek coverage under an individual permit. This permit is effective September 29, 2008. EPA Regions 1, 3, 6, 7, 8, 9, and 10 on 7/14/2008 are issuing their 2008 NPDES general permits for stormwater discharges from new dischargers engaged in large and small construction activities. Hereinafter, these NPDES general permits will be referred to as "permit" or "2008 construction general permit" or "2008 CGP." "New dischargers" are those who did not file a NOI to be covered under the 2003 construction general permit before it expired. Existing dischargers who properly filed an NOI to be covered under the 2003 CGP continue to be authorized to discharge under that permit according to its terms. The 2008 CGP contains the same limits and conditions as the Agency's 2003 CGP with the exception of a few minor modifications. No. 110-255) was signed into law on 30 June 2008 and it allows EPA to include diesel emissions-reduction projects as restitution in settlements of civil environmental enforcement actions. Motor vehicle air-conditioning (MVAC) refrigerant handling equipment must be certified by the Administrator or an independent organization approved by the Administrator and, at a minimum, must be as stringent as the standards of the Society of Automotive Engineers (SAE). SAE has replaced Standard J1732 with J2810, HFC-134a Refrigerant Recovery Equipment for Mobile Air Conditioning Systems. The controls will apply to all types of locomotives, including line-haul, switch, and passenger, and all types of marine diesel engines below 30 liters per cylinder displacement, including commercial and recreational, propulsion and auxiliary. The near-term emission standards for newly-built engines will phase in starting in 2009. This action amends rule language to correct applicability cross references that were not correctly amended between the most recent proposed and final rule revisions, and to clarify that condenser performance monitoring may be done by either of two prescribed methods (pressure or temperature), regardless of whether an installed pressure gauge is present. Without these amendments, new area sources could erroneously be required to perform monitoring that was proposed for only major sources, and installed condenser performance gauge readings could be required of sources when a prescribed temperature method is just as valid for compliance purposes. EPA is revising the level of the primary 8-h standard for O3 to 0.075 ppm, expressed to three decimal places. EPA is revising the secondary 8-h standard for O3 by making it identical to the revised primary standard. EPA is also making conforming changes to the Air Quality Index (AQI) for O3, setting an AQI value of 100 equal to 0.075 ppm, 8-h average, and making proportional changes to the AQI values of 50, 150 and 200. EPA is revising the February 26, 2007 mobile source air toxics rule's requirements that specify the benzene control technologies that qualify a refiner to generate early benzene credits. This revision allows another specific benzene control technology, benzene alkylation, in addition to the four operational or technological changes that the 2007 rule currently allows. This revision also includes a general provision that allows a refiner to submit a request to EPA to approve other benzene-reducing operational changes or technologies for the purpose of generating early credits. This revision is effective on May 12, 2008, without further notice, unless EPA receives adverse comment by April 11, 2008.
