ORDER
On August 27, 1998, the Administrative Review Board issued a Notice of
Appeal and Order Establishing Briefing Schedule in this matter. On September 22, 1998, the
Acting Administrator of the Wage and Hour Division filed a Motion to Remand and [to]
Suspen[d]. . . Briefing Schedule. The Acting Administrator conceded that Amfac Resorts,
L.L.C. (Amfac), did not have an opportunity to submit certain relevant information to the
Acting Administrator prior to his issuance of a final ruling. The Acting Administrator therefore
requested a remand in order to consider the information submitted by Amfac to the Board with
its appeal and to consider relevant additional information from interested parties. The Acting
Administrator requested that the briefing schedule be suspended pending our action on his
motion. On October 6, 1998, the Board issued an order allowing any party to respond to the
Acting Administrator's Motion within five calendar days of receipt of its order, and suspended
the briefing schedule pending further order of the Board.
On October 7, 1998, counsel for Amfac notified the Board that Amfac
does not oppose the motion to remand. On October 13, 1998, counsel for American Federation
of Government Employees, AFL-CIO, Local 1305, and Teamsters Local 959 also notified the
Board that the Locals do not oppose the remand.
Accordingly, we grant the motion of the Acting Administrator and remand
this matter, in accordance with 29 C.F.R. §8.1(d), to take additional evidence and to
reconsider his June 24, 1998 final ruling.
