NOTICE TO THE TRADE

F.A.S. Allocated Commodities at Houston and Jacinto


April 5, 2006

Attention: All Steamship Lines Participating in P.L. 480 Title II Food Aid Shipments

Subject: Consideration of f.a.s.-allocated commodities at Houston and Jacintoport

Effective with Invitation 046, USAID will use the following guidelines to allow ocean carriers to move cargo between USDA approved terminals listed under the Port of Houston and Jacintoport terminal (a list of approved terminals may be found at the following website http://www.fsa.usda.gov/daco/Export/ApprvdPortFacilities.pdf).

  1. If the ocean freight tender lists the availability of the commodity as f.a.s. Houston (HOUS), the ocean carrier may instruct the commodity supplier to deliver the commodity to any USDA approved terminal in Houston, or to the Jacintoport terminal. The ocean carrier will include all costs associated with handling the commodity at the terminal including the cost to unload the commodity from the commodity supplier’s conveyance and any port charges.
  2. If the ocean freight tender lists the availability of the commodity as f.a.s. Jacintoport (JACI), the ocean carrier may take delivery of the commodity f.a.s. at the Jacintoport terminal, or may divert the shipment to another USDA approved terminal in Houston under the following conditions:
    1. The commodity is delivered f.a.s. Jacintoport by the commodity supplier and the commodity is moved to a USDA approved terminal in Houston at the time, risk and expense of the ocean carrier; or
    2. The ocean carrier obtains written consent from USAID and USDA to direct the commodity supplier to deliver the commodity to another USDA approved terminal in Houston. In such instances, the ocean carrier would be responsible for the costs outlined in paragraph A. Written consent is required in order for USDA to adjust the commodity contract for handling and wharfage charges included in deliveries to Jacintoport.
