The complaint alleged that the Respondent violated § 7116(a)(1) and (8) of the Federal Service Labor-Management Relations Statute by failing to comply with an arbitration award involving compensation of employees for time spent commuting to their temporary duty assignment. The Judge denied the GC's Motion for Summary Judgment and granted the Respondent's Cross-Motion for Summary Judgment, finding that the charge was untimely filed. Accordingly, the Judge recommended that the complaint be dismissed.
The Authority adopted the Judge's findings, conclusions and recommended Order. The Authority agreed with the Judge that the unfair labor practice charge was untimely filed and dismissed the complaint.
