The Arbitrator dismissed the grievance, finding that the Agency's refusal to bargain over a reduction in force (RIF) did not violate the parties' agreement or law. The Authority found that the Union failed to demonstrate that the award was deficient under § 7122(a) of the Statute and denied the Union's exceptions.
The Authority found that the Union failed to demonstrate that the award was contrary to 5 U.S.C. § 3403(a). The Authority also rejected the arguments that the Arbitrator failed to conduct a fair hearing, or that he exceeded his authority.
