The Agency filed exceptions to the Arbitrator's award finding that the Agency violated a settlement agreement when it failed to consider calling in additional air traffic controllers when one of the scheduled controllers was granted sick leave on the day in dispute.
The Authority held that the Arbitrator did not exceed his authority; the award did not fail to draw its essence from the collective bargaining agreement and the settlement agreement; and the award was not contrary to management's right to assign work.
