The Agency sought review of the portion of the Regional Director's (RD's) Decision and Order including one employee in the bargaining unit represented by the Union.  The Authority denied the Agency's application.

 The Authority found that the Director was not significantly involved in formulating or effectuating management policies in the field of labor relations. Thus, the employee was not a confidential employee within the meaning of § 7103(a)(13) of the Statute.
