The Arbitrator ruled that, under the parties' collective bargaining agreement, the two grievants were entitled to pay for extra work they performed as the result of being assigned additional duties.The Authority denied the Agency's exceptions.
The Authority rejected the agency's contention that the award was contrary to 10 U.S.C. § 2164,finding that the Arbitrator was empowered to interpret and apply the compensation program contractually created in Article 28. The Authority also rejected the argument that the award failed to draw its essence from the agreement.
