PL 91-93 Civil Service Retirement Amendments of 1969 (enacted 10/20/69)

Title I - Civil Service Retirement Financing
Section 102 amends 5 U.S.C. Section 8334 by having employing agencies deduct and withhold 7% of the basic pay of an employee, 7.5% of the basic pay of a Congressional employee, and 8% of the basic pay of a Member. Effective after 12/31/69.
Title II - Civil Service Retirement Benefits
Section 203 states that the total service of an employee who retires on an immediate annuity or dies leaving a survivor or survivors entitled to annuity includes the days of unused sick leave to the employer credit under a formal leave system.
Section 204 increases the annuity of a child on or after the first day of the first month of the date of enactment of this Act.
Section 205 states that the widow or widower of an employee who died, retired, or was otherwise finally separated before 7/18/66, who remarried on or after such date, shall continue receiving annuity from the Civil Service Retirement and Disability Fund.
Section 206(a) amends 5 U.S.C. Section 8341 by stating that if an employee or Member dies after completing at least 18 months of civilian service, the surviving dependent spouse of the employee or Member shall receive an annuity that shall be the smaller of 40% of average pay, or the sum obtained after increasing the employee's service between the time of death and the date the employee would have become 60 years of age.
Section 206(b) states that if an employee or Member dies after completing at least 18 months of civilian service or dies after retirement, and is survived by a spouse, each surviving child is entitled to an annuity equal to the smallest of 75% of the average pay of the employee or Member divided by the number of children; $1,080; or $3,240 divided by the number of children.

 

PL 91-114 An Act to increase the maximum rate of per diem allowance for employees of the Government traveling on official business, and for other purposes. (enacted 11/10/69)

Amends 5 U.S.C. Sections 5702 and 5703 by increasing the maximum rate of per diem allowance for Federal employees traveling on official business.

PL 91-172 Tax Reform Act of 1969 (enacted 12/30/69)

Title X - Increase in Social Security Benefits
Section 1002 increases regular OASDI benefits by 15% with a minimum primary insurance amount of $64. Effective for months after 12/69.
Section 1003 increases by 15% the special payments for certain individuals aged 72 and older, who have no coverage or whose coverage is insufficient to qualify for regular benefits. Effective for months after 12/69.
Section 1004 eliminates the $105 limitation on wife’s, husband’s, widow’s, and widower’s insurance benefits. Effective for months after 12/69.
Section 1005 revises the allocation of tax receipts between the OASDI and DI Trust Funds.
Section 1006 requires each State, in determining the need of its public assistance recipients, to disregard any retroactive payment of the OASDI benefit increase provided by the bill for 1/70 and 2/70, which is expected to be paid in 4/70. This requirement would be limited to the situation created by the bill and would not apply to any retroactive payments which may result from future laws.
Section 1007 requires each State to assure every recipient of aid or assistance under any of its adult public assistance programs who also receive OASDI benefits that the recipient will realize an increase in the total of their public assistance and OASDI benefit payments equal to $4 a month. Effective between 3/70 and 7/70.

 

PL 91-173 Federal Coal Mine Health and Safety Act of 1969 (enacted 12/30/69)

 

 

 

 

 

Title IV - Black Lung Benefits
Part A - General
Section 401 provides benefits, in cooperation with the States and the HEW Sec., to coal miners who are totally disabled due to pneumoconiosis and to the surviving dependents of miners whose death was due to such disease.
Section 402(f) deems the term “total disability” in this Act to be no more restrictive than Section 223(d) of Title II of the Social Security Act.
Part B - Claims for Benefits Filed on or Before 12/31/72
Section 411(a) provides benefits in respect of total disability of any miner due to pneumoconiosis, and in respect of the death of any miner due to pneumoconiosis.
Section 411(c) sets standards for receiving benefits as; (1) a miner employed for ten or more years in one or more underground coal mines suffering from pneumoconiosis; (2) a deceased miner who was employed for ten or more years in one or more underground coal mines and died from a respiratory disease; (3) a miner suffering or who suffered from a chronic dust disease of the lung as shown by biopsy or autopsy.
Section 412(a)(1) states that in the case of total disability of a miner due to pneumoconiosis, benefits shall be paid at a rate equal to 50% of the minimum monthly payment to which a totally disabled Federal employee in grade GS-2 is entitled.
Section 412(a)(2) states that in the case of death of a miner due to pneumoconiosis, benefits shall be paid to his widow at the rate the deceased miner would receive such benefits if he were totally disabled.
Section 412(a)(3) states that in the case of a miner with one dependent, benefits will be increased by 50%; with two dependents, benefits will be increased by 75%; and with three or more dependents, benefits will be increased by 100%.
Part C - Claims for Benefits After 12/31/72
Section 421 states that on and after 1/1/73, any claim for benefits for death or total disability due to pneumoconiosis shall be filed pursuant to the applicable State workmen’s compensation law, except that during any period when miners or their surviving widows are not covered by a State workmen’s compensation law which provides adequate coverage for pneumoconiosis they shall be entitled to claim benefits.

Provides an additional amount of $1,545,413,000 for payment to Trust Funds for health insurance for the aged. Provides an additional amount of $105,000,000 for payment for military service credits. Provides an additional amount of $364,151,000 for payment for special benefits for the aged. Provides for such sums as may be necessary for special benefits for disabled coal miners. Provides an additional amount of $911,350,000 for limitation on salaries and expenses.

PL 91-216 Job Evaluation Policy Act of 1970 (enacted 3/17/70)

Title II – Statement of Policy
Section 201 states that it is the sense of Congress that the executive branch shall, in the interest of good administration, operate under a coordinated job evaluation and ranking system for all civilian positions; and the system shall be designed so as to utilize such methods of job evaluation and ranking that take into account the various occupational categories of positions therein.

 

PL 91-231 Federal Employees Salary Act of 1970 (enacted 4/15/70)

Section 2 increases the rates of basic pay, basic compensation, and salaries contained in the General Schedule by amounts equal, as nearly as may be practicable and with regard to maintaining approximately equal increments within any grade, level, or class of any such schedule, to 6%.
Section 3(d) increases the rates of pay of employees of the Federal Government and District of Columbia whose rates of pay are fixed by administrative action pursuant to law. Effective on the first day of the first pay period which begins on or after 12/27/69.
Section 4(c)(1) states that any Federal employee receiving less than the basic pay for level V of the Executive Schedule on the date of enactment of this Act, shall not have his or her salary increased to a rate in excess of level V.
Section 4(c)(2) states that any Federal employee receiving equal to or in excess of the basic pay for level V of the Executive Schedule, shall not have his or her salary increased.
Section 5 states that retroactive pay, compensation, or salary shall be paid to individuals in the service of the U.S. which includes the Armed Forces and or the government of the District of Columbia on the date of enactment of this Act.
Section 8 amends Title 5 U.S.C. Section 5545(c)(2) by giving employees in which the hours of duty require substantial amounts of irregular, unscheduled, overtime duty, premium pay for this duty on an annual basis. Effective on the date of enactment of this Act.
Section 9(c) considers all changes in rates of pay, compensation, and salary which result from the enactment of this Act, when determining the amount of group life insurance that a Government employee is eligible for.
Section 9(d) states that any deductions made from the pay, compensation, or salary of a Government employee enrolled in a retirement system of the U.S., and the contribution of the employing agency, shall be made at the rates of deductions in effect for that system on the date of such enactment.

PL 91-269 An Act to provide for Federal Government recognition of and participation in international expositions proposed to be held in the United States, and for other purposes. (enacted 5/27/70)

Section 1 states that the Federal Government will give international expositions orderly consideration by developing uniform standards, criteria, and procedures to establish the conditions under which such expositions will be held in the U.S. and take part in such expositions.
Section 3 allows the Federal Government to participate in an international exposition only upon the authorization of Congress and when the President finds that Federal participation is in the national interest.
Section 6 maintains that nothing in this Act shall affect or limit the authority of Federal departments and agencies to participate in international expositions authorized by law.

PL 91-418 An Act to increase the contribution by the Federal Government to the cost of health benefits insurance, and for other purposes. (enacted 9/25/70)

Section 1 adjusts the biweekly Government contribution for health benefits for employees or annuitants enrolled in health benefits plans, beginning on the first day of the first pay period of each year, to an amount equal to 40% of the average of the subscription charges in effect on the beginning date of the adjustment, with respect to self alone or self and family enrollments, as applicable, for the highest level of benefits offered. Effective after 12/31/70.
Section 4 amends The Retired Federal Employees Health Benefits Act by including SSA for purposes of supplementary medical insurance provided by Part B of Title XVIII of the Social Security Act. Effective 1/1/71.

 

PL 91-426 An Act to amend the Federal Property and Administrative Services Act of 1949 to permit the rotation of certain property whenever its remaining storage or shelf life is too short to justify its retention, and for other purposes. (enacted 9/26/70)

Section 1 states that whenever the head of any executive agency determines that the remaining storage or shelf life of any medical materials or medical supplies held by such agency for national emergency purposes is of too short duration to justify their continued retention for such purposes and that their transfer or disposal would be in the interest of the U.S., such materials or supplies shall be considered to be excess property and may be transferred or exchanged with any other Federal agency for other medical materials or supplies.

 

PL 91-438 A Joint Resolution expressing the support of the Congress, and urging the support of Federal departments and agencies as well as other persons and organizations, both public and private, for the international biological program. (enacted 10/7/70)

Section 2 calls upon all Federal departments and agencies and other persons and organizations, both public and private, to support and cooperate fully with the international biological program and the activities and goals of the U.S. National Committee and the Interagency Coordinating Committee.

PL 91-596 Occupational Safety and Health Act of 1970 (enacted 12/29/70)

 

Section 19 states that the head of each Federal agency shall provide safe and healthful places and conditions of employment; acquire, maintain, and require the use of safety equipment, personal protective equipment, and devices to protect employees; keep adequate records of all occupational accidents and illnesses for proper evaluation and necessary corrective action; consult with the Sec. of Labor with regard to the adequacy as to form and content of records kept; and make an annual report to the Sec. of Labor with respect to occupational accidents and injuries.

 

PL 91-630 An Act to permit certain Federal employment to be counted toward retirement. (enacted 12/31/70)

Section 1 repeals Section 115 of the Social Security Amendments of 1954.
Section 2 states that the repeal of Section 115 of the Social Security Amendments of 1954 shall not apply to any Federal employee who, on the date of enactment of this Act, is receiving or entitled to receive benefits under any retirement system established by the U.S. unless the employee requests, in writing, the office which administers the employee's retirement system to apply it. Effective on the first of the month following enactment of this Act.

PL 91-648 Intergovernmental Personnel Act of 1970 (enacted 1/5/71)

Title III - Training and developing State and Local Employees
Section 302(a) states that in accordance with such conditions as may be prescribed by the head of the Federal agency concerned, a Federal agency may admit State and local government employees and officials to agency training programs established for Federal professional, administrative, or technical personnel.
Title IV - Mobility of Federal, State, and Local Employees
Section 401 provides for the temporary assignment of personnel between the Federal Government and State and local governments and institutions of higher education.

PL 91-656 Federal Pay Comparability Act of 1970 (enacted 1/8/71)

Section 2 establishes that Federal pay for employees under statutory pay systems be based on the principles that there be equal pay for substantially equal work; pay distinctions be maintained in keeping with work and performance distinctions; Federal pay rates be comparable with private enterprise pay rates for the same levels of work; and pay levels for the statutory pay systems be interrelated.

 

PL 91-658 An Act to amend chapter 83 of Title 5, United States Code, relating to survivor annuities under the civil service retirement program, and for other purposes. (enacted 1/8/71)

Section 1 amends 5 U.S.C. Section 8332(f) by stating that an employee or former employee who returns to work after a period of separation is deemed to have been in a leave of absence without pay for that part of the period in which benefits were received.
Section 2 amends 5 U.S.C. Section 8339(j) by stating that an employee, who is unmarried at the time of retiring and who later marries, may receive a reduction in the current annuity, within one year after marriage with a written request.
Section 3 amends 5 U.S.C. Section 8341(a) by stating that if an employee dies after having retired and is survived by a spouse with whom the employee was married at the time of retirement or after retirement, the widow or widower is entitled to an annuity equal to 55%, or 50% if retired before 10/11/62, of the employee’s annuity.
Section 4 amends 5 U.S.C. Section 8344(a) by stating that if the annuitant dies while still reemployed, the survivor annuity payable is increased as though the reemployment had otherwise terminated.
