U.S. Department of Transportation Federal Aviation Administration and Professional Airways Systems Specialists (Harris, Arbitrator), 0-AR-3235 (Decided September 11, 2000)

      The Arbitrator sustained a grievance finding that the Agency did not have discretion under its Personnel Management System (PMS) to withhold the January 1999 government-wide wage increase. The Authority concluded that the Agency failed to establish that the award was deficient under section 7122(a) of the Statute. The Authority found that the Arbitrator had jurisdiction under the FAA Act to resolve the grievance and that the award was not inconsistent with Agency regulation.
