U.S. Department of Justice, Executive Office of Immigration Review Office of The Chief Immigration Judge and National Association of Immigration Judges, Case No. WA-RP-90056 (Decided September 1, 2000)

      The Agency sought review of the Regional Director's (RD's) Decision and Order dismissing the petition in this case. The Authority denied the application after concluding that the Agency did not establish compelling reasons for review.

      The Authority concluded that the RD did not commit a clear and prejudicial error concerning substantial factual matters relating to the Immigration Judges' decisions and involvement in other Agency activities. The Authority also concluded that the RD's decision did not raise an issue for which there was an absence of precedent. Lastly, the Authority concluded that the RD did not fail to apply established law.
