American Federation of Government Employees Local 1917 National Immigration And Naturalization Council and U.S. Department of Justice Immigration And Naturalization Service New York, New York (Gold, Arbitrator), 0-AR-3248 (Decided July 31, 2000)

      The Arbitrator found that the Agency did not violate the parties' agreement when it reassigned the grievant from the position of Special Agent to that of District Adjudications Officer. The Authority denied the exceptions.

      The Authority held that the award was not contrary to law, rule or regulation, specifically that the Agency policy was not violated. At issue before the Arbitrator was whether the Agency's reassignment of the grievant was proper. The Authority also concluded that the Arbitrator did not exceed her authority, nor that she failed to conduct a fair hearing.
