This award was the result of the remand ordered by the Authority in 53 FLRA 1782 (1998). The Authority found that the Agency failed to establish that the award was deficient under section 7122(a) of the Statute. The Authority concluded that the arbitrator did not improperly place the burden of proof on the agency to ascertain the grievant's medical condition, and that the award set forth a sufficient basis for finding there was no just cause for disciplining the grievant.
