State Implementation Plan (SIP) Revision & Designated Pollutant Plan Approvals


The following proposed approval for Delaware appears in the April 29, 2009 Federal Register:

Outer Continental Shelf Air Regulations Consistency Update for Delaware (40 CFR Part 55) - 74 FR 19472 (Proposed Rule)

SUMMARY: EPA is proposing to update a portion of the Outer Continental Shelf (OCS) Air Regulations. Requirements applying to OCS sources located within 25 miles of a State’s seaward boundary must be updated periodically to maintain continuity and ensure consistency with the regulations of the corresponding onshore area (COA), as mandated by section 328(a)(1) of the Clean Air Act (CAA). The specific portion of the regulations that are being updated pertains to the requirements for OCS sources in the State of Delaware (Delaware). The intended effect of approving the OCS regulations for Delaware is to regulate air emissions from OCS sources in accordance with the requirements onshore. The change to the existing requirements discussed below is proposed to be incorporated by reference into the Code of Federal Regulations and is listed in the appendix to the OCS air regulations.

Interested parties may submit comments to EPA by May 29, 2009. Instructions on how to submit comments are contained in the Notice of Proposed Rulemaking.


The following SIP Revision approval for Pennsylvania appears in the April 29, 2009 Federal Register:

Approval and Promulgation of Air Quality Implementation Plans; Pennsylvania; Transportation Conformity Requirement - 74 FR 19451 (Final Rule), 74 FR 19471 (Proposed Rule)

SUMMARY: EPA is taking direct final action to approve revisions to the Pennsylvania State Implementation Plan (SIP) submitted by the Commonwealth of Pennsylvania. The revisions establish State transportation conformity requirements. EPA is approving these revisions in accordance with the requirements of the Clean Air Act.

This rule is effective on June 29, 2009. Interested parties may submit comments to EPA by May 29, 2009. Instructions on how to submit comments are contained in each rulemaking notice.


The following SIP revision approval for Delaware appears in the April 17, 2009 Federal Register:

Approval and Promulgation of Air Quality Implementation Plans; Delaware; Update to Materials Incorporated by Reference - 74 FR 17771 (Final Rule)

SUMMARY: EPA is updating the materials submitted by Delaware that are incorporated by reference (IBR) into the State implementation plan (SIP).  The regulations affected by this update have been previously submitted by the Delaware Department of Natural Resources and Environmental Control (DNREC) and approved by EPA.  This update affects the SIP materials that are available for public inspection at the National Archives and Records Administration (NARA), the Air and Radiation Docket and Information Center located at EPA Headquarters in Washington, D.C., and the Regional Office.

This final rule is effective on April 17, 2009.


The following SIP revision approvals for Maryland, Pennsylvania, Virginia and West Virginia appear in the March 25, 2009 Federal Register:

1. Approval and Promulgation of Air Quality Implementation Plans; Pennsylvania; Update to Materials Incorporated by Reference - 74 FR 13014(Final Rule)

SUMMARY: EPA is updating the materials submitted by the District of Columbia that are incorporated by reference (IBR) into the State Implementation Plan (SIP).  The regulations affected by this update have been previously submitted by the Pennsylvania Department of Environmental Protection and approved by EPA.  This update affects the SIP materials that are available for public inspection at the National Archives and Records Administration (NARA), the Air and Radiation Docket and Information Center located at EPA Headquarters in Washington, D.C., and the Regional Office.

This final rule is effective on March 25, 2009.

2. Approval and Promulgation of Air Quality Implementation Plans; Maryland; Reasonably Available Control Technology Requirements for Volatile Organic Compounds - 74 FR 12556 (Final Rule), 74 FR 12777 (Proposed Rule)

SUMMARY: EPA is taking final action to fully approve revisions to the Maryland State Implementation Plan (SIP).  The revisions pertain to Maryland’s major source volatile organic compound (VOC) reasonable available control technology (RACT) regulation.  EPA is converting the conditional limited approval status of Maryland’s VOC RACT regulations to a full approval because EPA has approved all of the case-by-case RACT determinations submitted by Maryland pursuant to the generic provisions of its VOC RACT regulation as well as all of the RACT requirements for categories of VOC sources submitted by Maryland in accordance with the requirements of the Clean Air Act (CAA).

This rule is effective on May 26, 2009.  Interested parties may submit comments to EPA by April 24, 2008.  Instructions on how to submit comments are contained in each rulemaking notice.

3. Approval and Promulgation of Air Quality Implementation Plans; Virginia; Volatile Organic Compound Reasonably Available Control Technology for Reynolds Consumer Products Company - 74 FR 12572 (Final Rule), 74 FR 12775 (Proposed Rule)

SUMMARY: EPA is taking direct final action to approve revisions to the Commonwealth of Virginia’s State Implementation Plan (SIP).  This revision pertains to a State operating permit containing terms and conditions for the control of emissions of volatile organic compounds (VOCs) from Reynolds Consumer Products Company located in Richmond, Virginia.  The submittal is for the purpose of meeting the requirements for reasonably available control technology (RACT) in order to implement the maintenance plan for the Richmond 8-hour ozone maintenance area.  EPA is approving the revision to the Virginia SIP in accordance with the requirements of the Clean Air Act (CAA).

This rule is effective on May 26, 2009.  Interested parties may submit comments to EPA by April 24, 2008.  Instructions on how to submit comments are contained in each rulemaking notice.

4. Approval and Promulgation of Air Quality Implementation Plans; West Virginia; Amendments to the Control of Air Pollution from Combustion of Refuse - 74 FR 12560 (Final Rule), 74 FR 12776 (Proposed Rule)

SUMMARY: EPA is taking direct final action to approve a revision to the West Virginia State Implementation Plan (SIP).  The SIP revision amends a regulation (45 CSR 6) to control air pollution from combustion of refuse.  EPA is approving these revisions in accordance with the requirements of the Clean Air Act (CAA).

This rule is effective on May 26, 2009.  Interested parties may submit comments to EPA by April 24, 2008.  Instructions on how to submit comments are contained in each rulemaking notice.
