ARB CASE NO. 00-075
ALJ CASE NO. 2000-STA-28
DATE: July 10, 2003

In the Matter of:

NANCY YOUNG,
    COMPLAINANT,

    v.

SCHLUMBERGER OIL FIELD SERVICES,
    RESPONDENT.

BEFORE: THE ADMINISTRATIVE REVIEW BOARD

ORDER

By Motion for Reconsideration dated May 31, 2003, Complainant requests for the second time reconsideration of the final decision and order issued in this case on February 28, 2003.

As in her earlier Motion for Reconsideration, Complainant alleges that the ALJ did not adequately assure that she received due process, given her pro se status.

We considered the fairness of the ALJ's conduct of the hearing as part of our substantive review of Complainant's original objections to the ALJ Recommended Decision and Order. We concluded, among other things, that he afforded Complainant due process of law. ARB No. 00-75 (ARB Feb. 28, 2003).

By Motion for Further Review, dated April 2, 2003, Complainant again disputed the fairness of the proceedings below and claimed, among other things, that the ALJ tampered with evidence by allowing Respondent's counsel to handle and remove documents that Complainant asserts would have proved her case.

By Order of May 1, 2003, this Board explained that these latest allegations were not preserved for review.

The May 31, 2003 Motion for Reconsideration raises no new matters and thus provides no basis for further action by this Board.

   Accordingly, the motion is DENIED.

   SO ORDERED.
