NOTICE OF CASE CLOSING

   The Administrative Law Judge issued a recommended decision and order on December 17, 1999, imposing civil money penalties upon the Respondents for violation of the Fair Labor Standards Act, as amended, 29 U.S.C. 201 et seq, and the regulations issued thereunder at 29 C.F.R. §§580.1-580.18. The Administrator filed a petition for review and his appeal was docketed as ARB Case No. 00-022. The Respondents also filed a petition for review and their cross appeal was docketed as ARB Case No. 00-031.

   On February 8, 2000, the Administrator filed a motion withdrawing his appeal. We grant the Administrator's motion. Accordingly, this notice constitutes the final administrative action for ARB Case No. 00-022 and the case is Closed. The Respondents' appeal, ARB Case No. 00-031, is still pending.
