AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN THE
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

UNITED DAY LABORERS OF NEW JERSEY |
The Occupational Safety and Health Administration (OSHA),
the New Jersey Department of Labor and Workforce Development (LWD) and the
United Day Laborers of NJ (UDLNJ) recognize the value of establishing a
collaborative relationship to foster safer and more healthful American
workplaces.
OSHA, LWD and UDLNJ here-by form an Alliance to provide UDLNJ members and others
with information, guidance and access to training resources that will help them
protect non-English speaking employees’ and employees’ health and safety
particularly in reducing and preventing exposure to hazardous materials,
construction, electrical and fall hazards. In addition, this Alliance will
address hazardous occupations, hazard identification and communication, personal
protective equipment, on-the-job safety and health and employment / wage & hour
issues as well as employment issues, including wage disputes and hours of work
issues.
In developing this Alliance, OSHA, LWD and UDLNJ recognize that OSHA’s State
Plan and Consultation Project partners are an integral part of the OSHA national
effort.
OSHA, LWD and UDLNJ will work together to achieve the following training and
education goals::
- Work with OSHA to provide expertise to develop training resources and
related materials in Spanish for employers, employees and young workers who are
not fluent in the English language;
- Work with OSHA to provide expertise to develop workplace safety and health
curricula on a two hour safety & health training and employment overview program
in Spanish and in English to workers who frequent the UDLNJ offices;
- Deliver or arrange for delivery of the OSHA 10 hour Construction or the OSHA
10 hour General Industry Certificate Program for UDLNJ members.
OSHA, LWD and UDLNJ will work together to achieve the
following outreach and communication goals::
- Make available to Hispanic workers and their employers, safety and health
publications, audio-visual and other reference materials;
- Work with other Hispanic organizations in New Jersey in an effort to enhance
on the job safety and health and publicize worker rights;
- Encourage UDLNJ staff members and in particular, those that are bi-lingual,
to take the OSHA Train-the-Trainer course on either occupational safety and
health standards for the Construction Industry, occupational safety and health
standards for General Industry, or both, so they qualify to teach and issue
certifications to Hispanic and other workers upon completion of the respective
OSHA 10 and 30 hour safety and health courses;
- Promote and encourage the employers of UDLNJ members to participate in OSHA
cooperative programs such as compliance assistance, the free LWD/OSHA
Consultation Program and the Voluntary Protection Program.
OSHA, LWD and UDLNJ will work together to achieve the
following goals related to promoting the national dialogue on workplace safety
and health:
- Raise others’ awareness of and demonstrate their own commitment to workplace
safety and health whenever OSHA, LWD and UDLNJ leaders address groups;
- Develop and disseminate case studies and best practices illustrating the
business and social value of worker safety and health programs and publicize
their results in UDLNJ publications, OSHA newsletters and other media such as
local newspapers;
- Convene or participate in forums, roundtable discussions or meetings on
workplace safety and health, wage and hour and other worker protections and help
to forge innovative solutions to workplace safety & health and day laborer
employment issues.
OSHA Alliances provide parties an opportunity to
participate in a voluntary cooperative relationship with OSHA for purposes such
as training and education, outreach and communication and promoting a national
dialogue on workplace safety and health. These Alliances have proved to be
valuable tools for both OSHA and its Alliance participants. By entering into an
Alliance with a party, OSHA is not endorsing any of that party’s products or
services; nor do the Agencies enter into an Alliance with the purpose of
promoting a particular party’s product or services.
An implementation team made up of representatives from each of the signing
organizations will meet to develop a plan of action, determine procedures, and
identify the roles and responsibilities of the participants. In addition, they
will meet at least three times per year to track and share information on
activities and results in achieving the goals of the Alliance.
This agreement will remain in effect for two years. Any signatory may terminate
it for any reason at any time, provided they give 30 days written notice. This
agreement may be modified at any time with concurrence of all signatories.
