AGREEMENT ESTABLISHING AN ALLIANCE BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
BISMARCK AREA OFFICE
AND
ENERGY COALITION FOR CONTRACTOR SAFETY (ECCS)

The Occupational Safety and Health Administration (OSHA) and The Energy Coalition for Contractor Safety (ECCS) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. The ECCS is a group of North Dakota energy companies working together to achieve workplace safety excellence through standardized workplace safety practices, training, and drug screening of energy industry contractor employees. OSHA and ECCS hereby form an Alliance to use their collective expertise to help foster a culture of prevention while sharing best practices and technical knowledge.

OSHA and ECCS agree to establish an Alliance to promote safe and healthful working conditions for North Dakota energy company contractors by:
  • Providing ECCS members with information and guidance that will help them protect construction contactor’s employees’ health and safety while performing work at the member’s facilities.
     
  • Increasing access to safety and health information and training resources.
OSHA and ECCS will also work together to achieve the following training and education goals:
  • Providing opportunities for employees of construction contractors to complete the OSHA 10-hour course on hazards in the construction industry.
     
  • Provide training and education on OSHA recordkeeping for contractors.
ECCS will establish hiring and selection criteria for contractors that includes:
  • Review of the previous year’s OSHA injury rate to identify those with a 3.0 rate or less.
     
  • Review of the worker compensation Experience Modification Rate to identify contractor’s with1.0 or less.
     
  • Having a third party audit of the contractor’s safety and health program conducted.
OSHA and ECCS will work together to achieve the following outreach and communication goals:
  • Develop and disseminate information at conferences, events, or through print and electronic media, including links from OSHA’s and ECCS’s Web sites.
     
  • Speak, exhibit, or appear at conferences, local meetings, or other events including the annual North Dakota Safety and Health Conference sponsored by the North Dakota Safety Council.
     
  • Promote and encourage ECCS members’ and contractors participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Program, Consultation, and SHARP.
OSHA and ECCS will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise others’ awareness of and demonstrate their own commitment to workplace safety and health whenever ECCS leaders address groups.
     
  • Share information on best practices, as jointly determined by OSHA and ECCS of ECCS’s worksites with others in the industry through outreach and through OSHA or ECCS’s developed training programs and materials. Promote their implementation through print or electronic media, at conferences, or by other means of outreach.
     
  • Convene or participate in forums, round table discussions, or stakeholder meetings to help forge innovative solutions or provide input on any safety and health issues arising in the workplace.
An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Either signatory may terminate the alliance for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
