AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR 
BUFFALO AREA OFFICE

AND THE

U.S. DEPARTMENT OF HOMELAND SECURITY
TRANSPORTATION SECURITY ADMINISTRATION
BUFFALO NIAGARA INTERNATIONAL AIRPORT

The Occupational Safety and Health Administration (OSHA) and the Transportation Security Administration (TSA) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and TSA hereby form an Alliance to provide TSA employees at the Buffalo Niagara International Airport (BUF) with information, guidance, and access to training resources that will help them protect employees' health and safety by addressing airport passenger screening and baggage handling issues, particularly in reducing and preventing exposure to ergonomic, struck-by, crushed-in, electrical, and fall hazards. In developing this Alliance, OSHA and TSA recognize that OSHA's State Plan and Consultation partners are an integral part of the OSHA national effort.

OSHA and TSA BUF will work together to achieve the following training and education goals:
  • Work with OSHA to provide expertise in developing training and education programs on ergonomic, struck-by, crushed-in, electrical and fall hazards.

  • Deliver or arrange for the delivery of training sessions addressing hazards related to baggage handling and airport passenger screening such as ergonomic, crushed-in, struck by, falls and electrical for TSA employees.
OSHA and TSA BUF will work together to achieve the following outreach and communication goals:
  • Develop and disseminate information through print and electronic media, including electronic assistance tools (e.g., OSHA's Baggage Handling e-Tool) and links from OSHA's and TSA's Websites. 

  • Speak, exhibit, or appear at OSHA's or TSA BUF conferences, local meetings, or other similar events.

  • Cross-train OSHA personnel and industry safety and health professionals in TSA best practices or effective approaches, as jointly determined by OSHA and TSA.

  • Promote and encourage TSA BUF participation in OSHA's cooperative programs, such as compliance assistance and the Voluntary Protection Program. 

  • Share information on best practices, as jointly determined by OSHA and TSA, of TSA BUF worksites with others in the industry and publicize the results through outreach by TSA and through OSHA or TSA-developed training programs and materials. 

  • Build a collaborative relationship with OSHA's Region II Regional Office and Buffalo Area Office to address health and safety issues, including ergonomic, struck-by, crushed-in, electrical, and fall hazards.
OSHA and TSA BUF will work together to achieve the following goals related to promoting workplace safety and health:
  • Raise others' awareness of and demonstrate their own commitment to workplace safety and health whenever TSA BUF leaders address groups. 

  • Develop and disseminate case studies illustrating the business value of safety and health and publicize their results. 

  • Convene or participate in forums, round table discussions, or stakeholder meetings on airline safety issues such as ergonomics, struck-by, crushed-in, electrical and fall hazards to help forge innovative solutions in the workplace or to provide input on safety and health issues.
This OSHA Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes, such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting any particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of this Alliance.

All commitments made by the Federal signatory agencies to this Alliance are subject to the availability of appropriated funds and each agency's budget priorities. Nothing in this Alliance, in and of itself, obligates any of the Federal signatory agencies to expend appropriations or to enter into any contract assistance agreement, interagency agreement, or other financial obligations.

This Alliance is neither a fiscal nor a funds obligation document. Any endeavor involving reimbursement or contribution of funds between the parties to this Alliance will be handled in accordance with applicable laws, regulations and procedures, and will be subject to separate subsidiary agreements that will be effected in writing by representatives of all parties.

This Alliance does not create any right or benefit, substantive or procedural, enforceable by law or equity against the Federal signatory agencies their officers or employees, or any other person. This Alliance does not direct or apply to any person outside of the parties to this Alliance.

This agreement will remain in effect for two years. Either signatory may terminate this agreement for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
