Local Education Agencies (LEAs) are responsible for compliance with AHERA regulation. LEAs are defined in Section 198 of the Elementary and Secondary Education Act of 1965. They include any:
- school district
- owner of any private non-profit elementary or secondary school building
- governing authority of any school operated under the Defense Department's education system
- churches providing educational services
- other buildings specifically designated by the state.
The AHERA definition of school buildings that must be inspected for asbestos is as follows:
- Any structure suitable for use as a classroom, including a school facility such as a laboratory, library, school eating facility, or facility used for the preparation of food.
- Any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education.
- Any other facility used for the instruction of housing of students or for the administration of educational or research programs.
- Any maintenance, storage, or utility facility, including any hallway, essential to the operation of any of the facilities listed in 1, 2,or 3.
The LEA appoints and trains a current employee as Designated Person (DP) to oversee asbestos-related activity within LEA grounds. The DP's main responsibilities include:
- Ensuring that an initial inspection by an accredited individual is performed in order to identify all friable and nonfriable ACBM.
- Creating and maintaining an Asbestos Management Plan (AMP) for the LEA.
- Ensuring that the three-year reinspection of LEA buildings and grounds is performed by an accredited individual.
