Diesel Engine Consent Decrees: Additional Injunctive Relief/Offset Projects

Six companies are required to fund additional injunctive relief described at Part IX in the diesel engine Consent Decrees - Caterpillar, Cummins, Detroit Diesel ("DDC"), Mack, Renault and Volvo. The total amount levied for injunctive relief is $109 million. Of this total amount, up to 30 percent may be held back by companies as part of an incentive program for them to achieve additional NOx reductions beyond the levels required by the Consent Decrees. Twenty percent of the remaining funds go to California-approved projects, 55 percent will be put toward projects identified under Appendix E of the Consent Decrees and 25 percent will be made available for Company Proposed Projects, to be selected according to the process described in the Consent Decrees at Part IX Additional Injunctive Relief, Section C Additional Injunctive Relief/Offset Projects. Projects, and the required associated Scopes of Work were approved by EPA and are underway. Detroit Diesel Corporation and Mack Trucks Inc. elected to perform an incentive program project.
