Alternate Test Procedures

In accordance with 40 CFR Part 136, Region 9 announces that it will accept alternate test procedure (ATP) applications submitted through the state permitting office for methods which have been recommended for interim Regional approval by the Office of Science and Technology's (OST), Office of Water. Such applications are subject to the requirements and procedures set forth in 40 CFR Part 136.5, which permits use of ATP for use in National Pollutant Discharge Elimination System (NPDES) monitoring. Region 9 also announces that OST has issued a memorandum "Flexibility to Modify CWA Methods (PDF)" (6 pp, 303K), dated November 20, 2007, discussing the flexibilities permitted for modifying Clean Water Act methods without prior EPA approval, pursuant to a recently-adopted regulation. The regulation, 40 CFR 136.6, was adopted on March 12, 2007, as part of EPA's Guidelines Establishing Test Procedures for the Analysis of Pollutants Under the Clean Water Act; National Primary Drinking Water Regulations; and National Secondary Drinking Water Regulations; Analysis and Sampling Procedures (Final Rule, 72 Fed. Reg. 11200, March 12, 2007, see Pages 11239 through 11241).
