PROJECT DESCRIPTION:

The TransCanada Keystone Pipeline, L.P. (Keystone) Company has applied for a right-of-way (ROW) permit through various easement lands in six U.S. Fish and Wildlife Service (Service) Wetland Management Districts in Nelson, Steele, Barnes, and Ransom Counties in North Dakota and Marshall, Beedle, Kingsbury, and Miner Counties in South Dakota.  Keystone plans to construct and operate a crude oil pipeline and related facilities to transport Western Canadian Sedimentary Basin crude oil from an oil supply hub near Hardisty, Alberta, Canada to an existing terminal and refinery at Wood River, Illinois, and an existing terminal at Patoka, Illinois. The Department of State (DOS) receives and considers applications for Presidential Permits for such oil pipelines pursuant to the authority delegated to it by the President of the United States under Executive Order (E.O.) 13337 as amended (69 Federal Register [FR] 25299). DOS determined that issuance of a Presidential Permit would constitute a major federal action that may have a significant impact upon the environment within the context of the National Environmental Policy Act of 1969 (NEPA) (42 United States Code [USC] § 4321 et seq.).  To comply with NEPA, DOS prepared an environmental impact statement (EIS) http://www.keystonepipeline.state.gov. The Service participated in, and is recognized as, a cooperating agency in the EIS.

Pursuant to 50 Code of Federal Regulations (CFR) §29.21-9(f) “..the Regional Director (U.S. Fish and Wildlife Service) shall give notice to federal, state, and local government agencies and the public, and afford them the opportunity to comment on right-of-way applications.” In accordance, we are hereby providing public notification of receipt of this application.
