Guidance on the Implementation of the March 2, 1999 Court Decision

On March 2, 1999, the United States Court of Appeals for the District of Columbia Circuit issued a decision on EPA's third set of transportation conformity amendments in response to a case brought by the Environmental Defense Fund. On April 16, 1999, the Department of Justice, EPA, and DOT decided not to appeal the Court of Appeals decision. The DOT's 01/02/02 Guidance, together with EPA's 5/14/99 Guidance provide for an interim process to implement this decision until EPA issues revised conformity regulations.
