The Construction Safety Excellence Demonstration Program (CSEDP) is a new avenue for demonstrating the capability of a contracting construction company to develop and administer a comprehensive safety and health program that provides excellent worker protection when implemented at all or some of its construction sites where the contractor has safety and health responsibility. The CSEDP incorporates the high standards of the Star Voluntary Protection Program (VPP), modified and strengthened to embody the unique needs of this industry.
Requirements particular to this program are as follows:
(1) The applicant company must submit one application covering all essential elements of its safety and health program and the implementation and enforcement strategies of these elements at the sites that the company designates for the program. In contrast, one application is required from each site applying to Star.
(2) The applicant company may designate new or ongoing construction sites for inclusion in the program. New construction sites are not considered for Star because sites must be in operation for at least one year prior to making application to Star.
(3) The three-year average Days Away From Work Injury (DAWI) Rate (excludes restricted cases) for company employees at all sites managed by the applicant company must be at least 50 percent below the most recently published Bureau of Labor Statistics (BLS) average for the applicable Standard Industrial Classification Code (SIC). This requirement is more stringent than the criterion for Star which has no DAWI requirement.
(4) Subcontractors at each designated site must demonstrate:
a. Injury Incidence Rates (IIR) and Lost Workday Injury (LWDI) Rates at or below the most recently published BLS industry average for the applicant's SIC, and
b. Days Away From Work Injury (DAWI) Rates at or below 50 percent of the most recently published Bureau of Labor Statistics (BLS) average for the applicable SIC.
These are not current Star requirements.
(5) Continuation in the program requires that the Rates requirements in paragraphs (3) and (4) above are maintained by the applicant company, by each designated site (subcontractor injury rates included), and by each subcontractor at each site.
The Construction Safety Excellence Demonstration Program also establishes application review and site evaluation procedures that reflect the uniqueness of the construction industry. For example, OSHA's review of the contracting construction company application will consider the substance of the company's safety and health program and the implementation strategies developed for each site for which program approval is sought. Additionally, site evaluations subsequent to a first year mandatory evaluation will be made based on the number of sites a company has in the program and on OSHA's experience with that company.
The period of demonstration for this Construction Safety Excellence Demonstration Program will be up to five years. After the demonstration period, the Program will be offered as a new, ongoing OSHA program if it successfully demonstrates a contracting construction company in control of two or more worksites can develop, implement, and maintain a safety and health program at those sites that ensures the high standards of safety and health excellence that have become synonymous with Star.
