7.1 Purpose. This chapter provides procurement guidance for energy and water efficient products.

7.2 Authorities.

A. Energy Policy and Conservation Act, as amended by the Energy Policy Act of 1992 (42 U.S.C. 6201 et seq.)

B. Section 507 of Executive Order 12902, Energy Efficiency and Water Conservation of Federal Facilities, March 8, 1994.

C. 48 CFR 23.2, Energy Conservation (FAR).

D. IARC 94-33, Acquisition and Use of Energy Efficient Products, Office of Acquisition and Property Management, March 16, 1994.

7.3 Policy. The Service will consider energy and water efficiency in the procurement of products and services. Energy and water conservation and efficiency data shall be considered along with estimated cost and other relevant factors in the preparation of plans, drawings, specifications, and other product descriptions.

7.4 Guidance. Pursuant to Sec. 507 of EO 12902:

A. "Best Practice" Technologies.

(1) OMB (Office of Federal Procurement Policy), in consultation with DOD (Defense Logistics Agency), DOE and GSA, will issue guidelines that identify energy- and water-efficient products. These guidelines will be updated annually and distributed within the Service by the Division of Contracting and General Services.

(2) The Service will purchase products listed in these guidelines whenever practicable, and whenever they meet the Service's performance requirements and are cost-effective.

B. Market Encouragement.

(1) To further encourage a market for highly efficient products, the Service will increase, to the extent practicable and cost-effective, purchases of products that are in the upper 25 percent of energy efficiency for all similar products, or products that are at least 10 percent more efficient than the minimum level that meet Federal standards. This requirement applies wherever such information is available, either through Federal or industry-approved testing and rating procedures.

(2) GSA and DLA, in consultation other agencies, States, industry and nongovernment organizations, will provide Federal agencies, in both printed and electronic formats, with information on specific products that meet these criteria. The Division of Contracting and General Services is responsible for ensuring that this information is disseminated within the Service.
