H-1B Work Visa for Specialty Occupations - Labor Condition Application Program

The H-1B program helps employers hire foreign workers to fill temporary vacancies in specialty occupations. The Department of Labor certifies Labor Condition Applications which employers submit attesting that employment of the foreigner will not adversely affect the working conditions of U.S. workers similarly employed.

  • The program is vulnerable to fraud and abuse because the Department of Labor has limited authority to question the Labor Condition Application.
  • The program has relevant performance indicators and reached both targets of processing 100% of applications timely in 2005.

About Improvement Plans

We are taking the following actions to improve the performance of the program:

  • Implementing new government-wide information technology security standards as appropriate.
  • Advocating the need for statutory changes that would require employers filing H-1B applications to test the labor market to ensure no U.S. workers are available and willing to fill the position.
  • Collaborating with the Department of Homeland Security and Department of State in a multi-agency data sharing effort to identify, address, and deter H-1B and other visa fraud.
