Right to Further Review

Either party may request, within 30 calendar days of a final determination or corrective action order by the Director of OARM, review by the Deputy Attorney General of that determination or order. An interlocutory appeal is an appeal of a ruling made by OARM after the commencement of your whistleblower reprisal case, but prior to issuance of a final determination (e.g., a ruling on jurisdiction, discovery matters, etc.).

No. The applicable FBI whistleblower laws do not expressly provide for a right to an interlocutory appeal to the Deputy Attorney General. The parties have the right to appeal only the Director of OARM's final determination on the merits of a complainant's request for corrective action and/or any corrective action order resulting therefrom.
