Briefing Sessions for Performance Track Members on EPA's Anticipated Proposed Rulemaking Related to Flexible Air Permitting

EPA's Office of Air Quality Planning & Standards (OAQPS) and Performance Track Program are pleased to invite Performance Track members to participate in the following briefing session focused on EPA's proposed rulemaking related to flexible air permitting.

About EPA's Proposed Flexible Air Permitting Rule
EPA believes the proposed rulemaking is an example of "innovation done right."  The proposed rule revisions are based, in large part, on lessons learned through pilot flexible air permitting experiences. The goal of that effort was to provide sources operational flexibility so that they could more effectively compete in the global market, and, at the same time, assure environmental protection and promote pollution prevention. Flexible permitting approaches allow a permitted air emissions source, under protection of the permit shield, where available and authorized by the permitting authority, to make certain types of physical and operational changes without further review or approval by the permitting authority. The collection of flexible permitting approaches addressed by this rulemaking build upon existing regulatory provisions that afford operational flexibility, such as the plantwide applicability limit (PAL) provisions of the December 2002 NSR Improvement rule.

About the Briefing Session
The session will provide Performance Track members with specific insights into the key provisions of EPA's proposed rule, as well as an overview of smart permitting and flexible permitting. Members will also have the opportunity to learn how flexible air permitting techniques can be incorporated into their facilities' regulatory plans. Finally, participants will be asked to provide their unique perspectives regarding the proposed rule and potential approaches EPA should consider in responding to the business concerns and implementation needs of Performance Track members.
